These General Terms and Conditions apply to Customers who perform one, some or all of the following actions: accessing, creating, or using an Account; booking or purchasing Tickets on Sun World's Ticketing Channel; and/or visiting and using Tickets at the Parks.
A. DEFINITIONS
1. Sun World: Sun World Group Company Limited (Enterprise Registration No.: 0401805040).
2. Park(s): amusement parks, theme parks, tourist attractions, entertainment areas and other models under the Sun World brand, including but not limited to: Sun World Ba Na Hills, Sun World Fansipan Legend, Sun World Hon Thom, Sun World Ba Den Mountain, Sun World Cat Ba, Sun World Ha Long, Sun World Sam Son, and other Sun World-branded parks/attractions that may be put into operation from time to time and published on Sun World's Ticketing Channel.
3. Park Operator: the company/branch that directly manages, operates and conducts business activities of a Park.
4. Sun World Ticketing Channel: the website https://booking.sunworld.vn/en ("Sun World Website") and/or Sun World's ticketing application "Sun Paradise Land".
5. Other Distribution Channel(s): distribution channels that resell or provide Tickets other than the Sun World Ticketing Channel or those directly provided by Sun World, and which receive Tickets from Sun World for further distribution. Other Distribution Channels include, without limitation: ticket agents, travel companies, tour guides, partners, and other corporate customers of Sun World, etc.
6. Ticket(s): tickets for park entry, cable car rides, participation in games/attractions, food & beverage, or other products/services at a Park.
7. Customer(s): individuals or organizations that perform one, some or all of the following actions: accessing, creating, or using an Account; booking or purchasing Tickets on Sun World's Ticketing Channel; and/or visiting and using Tickets at the Parks.
8. Order(s): the set of detailed information of each transaction created each time a Customer purchases Tickets on the Sun World Ticketing Channel, including key information such as: Ticket type, date/time of use, quantity, payment amount and other related information.
9. Account: the Customer's account created on the Sun World Ticketing Channel to conduct transactions.
B. GENERAL PROVISIONS
1. Any contents, rules and policies incorporated by reference in these General Terms and Conditions form an integral part hereof, and these General Terms and Conditions form an integral part of the contract/agreement for the provision and use of Tickets/services confirmed between Sun World and the Customer ("Contract"). In case of any inconsistency between these General Terms and Conditions and any other provisions on the same subject matter, these General Terms and Conditions shall prevail, unless such other provisions expressly state that they take precedence.
2. The Customer agrees and acknowledges that by accessing or conducting any actions/transactions on the Sun World Ticketing Channel, the Customer has read, understood and accepted the relevant provisions of these General Terms and Conditions. Sun World may amend, modify, add or remove any part of these General Terms and Conditions from time to time. Such changes shall take effect immediately upon being officially updated on the Sun World Website without prior notice to the Customer. The Customer is responsible for reviewing these General Terms and Conditions regularly and carefully before proceeding.
3. If any part of these General Terms and Conditions is deemed invalid or unenforceable in whole or in part by a competent authority, the validity of the remaining provisions shall not be affected. Any invalid provision shall be adjusted in accordance with Vietnamese law.
4. For Customers who are Other Distribution Channels, in addition to these General Terms and Conditions, such Customers must comply with and perform other rights and obligations as set out in the Contract entered into between Sun World and such Customer.
5. Other Distribution Channels are responsible for providing and referencing these General Terms and Conditions to their end customers prior to such end customers purchasing/receiving Tickets from them.
6. These General Terms and Conditions and all matters arising from the contractual relationship between Sun World and the Customer shall be interpreted and governed by Vietnamese law.
C. TICKET INFORMATION AND PRICES
1. Detailed information about Tickets and Ticket prices is published on the Sun World Ticketing Channel and/or at the Parks. For further information, or to contact Sun World for complaints, comments or service quality feedback, the Customer may contact Sun World's customer care details published on the Sun World Website.
2. The Customer represents that they have reviewed and understood all information relating to Tickets and Ticket prices before purchasing Tickets.
D. ACCESS AND USE OF SUN WORLD'S TICKETING CHANNEL
When accessing, creating and using an Account, booking/purchasing Tickets and conducting transactions on the Sun World Ticketing Channel, the Customer must ensure that:
1. The Customer has full capacity for civil acts and legal capacity, and has obtained all necessary permits/approvals/authorizations from competent authorities and, where applicable, from the Customer's legal representative, to access and use the Ticketing Channel, create an Account, book/purchase/receive/use Tickets and conduct related transactions. Sun World may request the Customer to provide relevant documents to verify such information and capacity. For clarity, Sun World's request for verification is solely for Sun World's risk management purposes and does not create any liability of Sun World regarding the Customer's capacity under law.
2. The Customer provides complete, truthful and accurate information and must not use or falsify information of any other individual or organization.
3. The Customer must keep Account information and passwords confidential and manage and control any assignment/authorization for the Customer's representatives to use the Account and conduct transactions.
4. The Customer is responsible for all transactions and transaction data conducted under the Customer's name or from the Customer's Account, as well as any consequences arising from disclosure of Account credentials. If the Customer detects any sign that the Account is compromised, taken over, or used beyond the Customer's authorized scope, the Customer must immediately notify Sun World for coordination and preventive action.
5. The Customer must not use information, data, software, services or products obtained from the Sun World Ticketing Channel for any of the following acts without Sun World's prior written consent, including but not limited to: modification, copying, display, operation, reproduction, publication, licensing, creating links, transfer, commercial exploitation, creating independent content for posting, distribution, or retransmission.
6. The Customer must comply with Vietnamese laws on information technology, electronic transactions and electronic payments, and other applicable laws in the online environment.
E. TICKET BOOKING, PAYMENT AND TICKET ISSUANCE
1. By using the booking and payment functions on the Sun World Ticketing Channel, the Customer is deemed to have accepted and shall comply with all regulations, policies, instructions, conditions, terms and notices published on the Sun World Website, including but not limited to these General Terms and Conditions. If the Customer does not intend to book/pay or does not agree with any term, the Customer should stop using the function.
2. The Customer selects Ticket type, quantity, date of use and any add-on services (if any) and provides complete and accurate information as required by the system. Upon completion of booking, the system will record an Order pending payment. The Order will be reserved for up to fifteen (15) minutes from successful Order creation. If payment is not completed within such period, the Order will be automatically cancelled; the Tickets and related services (if any) will be returned to available status for other transactions, and Sun World is not obliged to preserve the price, quantity or conditions of the expired Order.
3. The Customer makes payment using the payment methods made available by Sun World on the Website from time to time. An Order is deemed successfully paid only when Sun World's system records the transaction as successful and Sun World has received the full payment amount. Sun World shall not be responsible for cases where the Customer enters incorrect payment details, the transaction is declined by a bank/payment intermediary, or incidents arise from the payment service provider beyond Sun World's control.
4. An Order will be cancelled if: (i) the 15-minute payment period expires without successful payment; (ii) Sun World or the system detects fraud, policy abuse, abnormal transactions, or for technical/system security reasons; or (iii) the Customer does not complete payment before the transaction is recorded as successful. For Orders that have been successfully paid, Ticket cancellation shall be subject to the separate exchange/cancellation/refund policy applicable to each Ticket type (if any). If no refund or cancellation policy applies, Tickets cannot be cancelled or refunded.
5. After successful payment, the Customer will receive an electronic ticket (E-ticket), unless otherwise notified for a specific product. Within a maximum of 15 minutes from successful payment, the system will display the Ticket in the Customer's account/order on the Website and/or send the Ticket to the email or electronic channel provided by the Customer. When using services, the Customer must present the E-ticket code (QR code or booking code) at the control gate. Sun World may refuse service if the Ticket is invalid, already used, altered, forged or used improperly. The Customer must keep Ticket information, QR code and order code confidential, must not share the Ticket if transfer is not permitted, and must check Ticket information immediately upon receipt.
6. Unless otherwise provided, an Order becomes effective when Sun World confirms acceptance and receives payment.
7. Before confirming booking/purchase and payment, the Customer must carefully review all Order details.
8. Upon receiving the Ticket, the Customer must verify the Ticket type, quantity and relevant information to ensure accuracy with the paid Order. If there is any discrepancy, the Customer must notify Sun World within the following time limits for timely adjustment/handling: a. For Tickets purchased more than 24 hours before the date of use: within (i) no more than 15 days from Ticket receipt; and (ii) at least 24 hours before the date of use. b. For Tickets purchased within 24 hours prior to the date of use: immediately upon Ticket receipt. After such time limits, if Sun World does not receive the Customer's notice, Sun World may refuse to adjust/handle the Ticket.
9. Sun World may cancel a confirmed Order in certain cases, including: a. Where Sun World believes the Customer has signs of: (i) exploiting loopholes/system errors/mistakes leading to incorrect Ticket information (including but not limited to price, features, Ticket type and associated conditions/benefits); (ii) breaching Sun World's rules when entering into the Contract. b. Where Sun World has grounds to determine the Contract is invalid under law.
10. Where an Order is confirmed cancelled in whole or in part, the corresponding amount paid for the cancelled portion will be refunded to the Customer in accordance with Sun World's applicable policies from time to time. Tickets corresponding to the cancelled portion will no longer be valid for use.
11. The Customer may request a valid financial invoice for the Order in accordance with law. The Customer must provide complete and accurate invoicing information. Sun World will not support any request/change to invoicing information after the invoice has been issued. Note: Sun World does not support splitting or combining multiple Orders to issue an invoice for such split/combined Orders in any case.
12. Payment: a. Payment methods applicable to Ticket purchases via Sun World's App and/or Website are detailed on the Sun World Ticketing Channel. Depending on system availability, the Customer may choose one or more of the following methods: (i) QR code payment based on payment QR provided by National Citizen Commercial Joint Stock Bank (NCB) or via linked banking platforms supporting QR payment standards under applicable law; (ii) Credit/debit card payment issued by lawful card issuers in Vietnam or abroad, including common card types accepted by the system at the time of payment (e.g., Visa, MasterCard, JCB or other card types as specifically notified on the Sun World Ticketing Channel). b. When paying online, the Customer shall only make payment on the payment windows/interfaces opened via links from the Sun World Ticketing Channel and provided by the lawful payment intermediary. The Customer can only pay using the displayed methods and with a compatible card/account/e-wallet supported at the payment step. The Customer bears any fees charged by the payment intermediary (if any); such fees are between the payment intermediary and the Customer and are not included in Sun World's Ticket price. c. In case of any payment issues, the Customer should immediately contact Sun World or the payment intermediary for review and handling. d. For payment security, the Customer should: (i) follow the process and instructions on the Website and at the payment steps; (ii) use and keep card/account information secure and bear responsibility for any leakage due to the Customer's fault; (iii) for international credit/debit cards, never disclose CVV/CVC/CSC (the 3-digit security code printed on the back of the card).
F. TECHNICAL ISSUES
1. Sun World will use reasonable efforts to maintain normal operation of the Sun World Ticketing Channel. However, Sun World does not warrant that (i) functions/tools will be uninterrupted or error-free; (ii) the Ticketing Channel is free from viruses/malware or other harmful components; and/or (iii) all data provided is accurate and free of technical errors.
2. In case of technical incidents such as hardware issues, software bugs, internet connection issues, virus infection ("Technical Issues") or data errors such as pricing errors ("Data Errors"), Sun World will use reasonable efforts to rectify Technical Issues or correct Data Errors as soon as practicable.
3. Sun World may cancel the validity of and refuse to process transactions that are: a. due to Technical Issues; and/or b. based on Data Errors; and/or c. affected by Technical Issues and/or Data Errors, regardless of their origin.
4. If Sun World refuses a transaction, Sun World will notify the Customer via email/phone number provided upon Account registration/booking, and refund the relevant payment received by Sun World within up to thirty (30) working days.
5. Other than refunding the received payment, Sun World shall not be liable for any loss or damage suffered by the Customer, whether direct or indirect, arising from or relating to Technical Issues and/or Data Errors.
G. TICKET USE, REFUND, CANCELLATION AND EXCHANGE
1. The Park Operator may refuse entry and/or service and Sun World will not refund the Ticket price and shall bear no liability if the Customer fails to present a valid Ticket as required. Each Ticket is valid for one (01) use only. The Customer must protect Ticket information and code to prevent third parties from using it. The Ticket form (paper, electronic, etc.) must match the Ticket type purchased.
2. Purchased Tickets are not automatically eligible for refund, extension, cancellation, or exchange to another Ticket type, unless permitted by Sun World and/or the Park Operator under the applicable Ticket refund/cancellation/exchange policy published at: https://sunworld.vn/en/refund-policy, or under another arrangement approved by Sun World and/or the Park Operator.
3. A Park may be closed, postponed or temporarily suspended due to force majeure. In such cases, the Customer should remain calm and follow Sun World's instructions. If such closure/postponement/suspension results in the Customer being unable to use the main service stated on the Ticket, refund/extension/exchange (if any) shall be handled in accordance with Sun World's and/or the Park Operator's policy from time to time.
4. For clarity, a force majeure event is an objective event that is unforeseeable and beyond the control of the Parties, including but not limited to: natural disasters, weather, epidemics, fire, earthquakes, tsunamis and other natural disasters; riots, wars, national emergencies, terrorism, disturbances, strikes; sanctions, embargoes, changes in policies and laws by competent authorities; operational conditions, maintenance/servicing requirements, or other causes beyond the control of Sun World and/or the Park Operator.
5. Sun World and/or the Park Operator may invalidate Tickets without compensation if the Tickets are obtained from improper or unlawful sources.
6. Sun World is only directly responsible for handling refund/extension/exchange for Tickets purchased directly from Sun World. For Tickets purchased/received from Other Distribution Channels, the Customer shall work directly with such channel in accordance with the agreement between the channel and the Customer.
7. Unless otherwise agreed between Sun World/the Park Operator and the Customer, the Customer is not permitted to sell any products or services (including Tickets) inside the Park area, at the entrance, surrounding areas and within areas managed by the Park Operator without Sun World's or the Park Operator's prior written consent.
8. In case of violation, the Park Operator may cancel, refuse to recognize, and refuse the use within the Park of Tickets/products/services sold by the Customer in such case.
9. Without prejudice to the general principles above, refund/cancellation/extension/exchange (if applicable) shall be implemented in accordance with the Ticket refund/cancellation/exchange policy issued by Sun World and/or the Park Operator from time to time and publicly posted on the Sun World Ticketing Channel at: https://sunworld.vn/en/refund-policy. Such policy forms an integral part of these General Terms and Conditions. By purchasing Tickets, the Customer is deemed to have read, understood and agreed to be bound by the policy effective at the time of the transaction.
10. In case of any discrepancy or conflict between these General Terms and Conditions and the Ticket refund/cancellation/exchange policy, the policy published at the time the Customer purchases the Ticket shall prevail.
H. PERSONAL DATA PROTECTION POLICY
The Customer agrees that Sun World and/or the Park Operator may collect and use the Customer's personal data and images collected during the Customer's access, creation and use of an Account, purchase and use of Tickets and visit to the Park, for the purposes of entering into and performing the Contract, improving service quality, marketing/communications, statistics, and/or providing to Sun World's/Park Operator's service providers, contractors, and professional advisors, and/or other purposes not contrary to Vietnamese law.
The Customer should read and decide whether to agree with the detailed Personal Data Protection Policy published on the Sun World Website at: https://sunworld.vn/en/privacy-policy before agreeing to these General Terms and Conditions.
I. GENERAL RULES WHEN VISITING AND USING TICKETS AT THE PARK
1. Customer acceptance of risks and limitation of Sun World's liability in certain cases
Customer knows and understands that the Park has services and thrill rides that may not be suitable for persons whose height, weight and body size do not meet the requirements and for persons with health problems, elderly persons and children. In addition to the specific physical and health requirements posted at the control gate of each service and ride, the Customer commits and warrants that he/she does not have any musculoskeletal, cardiovascular, respiratory or other medical conditions that may be aggravated when experiencing the services and rides. When purchasing Tickets, the Customer agrees to take responsibility and will not request Sun World, the Park Operator or the operating and instructing personnel to bear responsibility for risks, damages and losses that may arise during and after participating in the rides which are not caused by the fault of Sun World, the Park Operator and the operating and instructing personnel, including but not limited to: a. Impacts on health, mental condition or life due to the Customer not ensuring sufficient health and physical condition and/or due to the Customer's medical condition being unsuitable for the rides and services; b. Damage or loss of the Customer's property carried by the Customer due to failure to comply with the instructions and regulations of the operating and instructing personnel; c. Other damages and losses not caused by the fault of Sun World, the Park Operator and the operating and instructing personnel.
2. Customer is not permitted to bring into the Park any weapons, dangerous tools, flammable and explosive substances, hazardous chemicals or any tools, materials or substances that may endanger human health, life, the environment or property.
3. Customer shall visit the Park and participate in rides and services in a civilized and polite manner, and shall not engage in excessive actions, gestures or speech, make noise, cause disorder or affect the Park and other persons.
4. Customer is not permitted to smoke, consume alcohol or use other stimulants in areas and locations where it is not permitted.
5. Customer shall not litter and must comply with environmental hygiene regulations stipulated at the Park.
6. Customer is responsible for reading and must comply with any signs, instructions, internal rules, regulations and provisions applicable to the Customer posted inside and outside the entrance of the Park, ticketing area, control gate of each ride and/or on the Sun World Website. At the same time, the Customer is obliged to comply with the instructions of the operating, instructing and service personnel of the Park to ensure order, safety and better service to Customers.
7. If Customer does not read and comply with the applicable signs, instructions, internal rules, regulations and provisions or does not comply with the instructions of the operating, instructing and service personnel, resulting in accidents, injuries or any losses, Sun World and the Park Operator shall not be responsible.
8. Customer is not permitted to communicate or disseminate information or make any statements or acts conveying untrue or incomplete information about Sun World, the Park Operator and/or the Park that may affect the image, reputation and brand of Sun World, the Park Operator and/or the Park.
9. Consequences when the Customer violates In addition to liabilities under Vietnamese law and under the Contract between the Customer and Sun World, if the Customer is found to have any signs or acts of violation, Sun World and the Park Operator have the right to: a. Request the Customer to leave the Park without any obligation to refund the Ticket price to the Customer. At the same time, Sun World has the right not to allow the Customer to visit the Park in subsequent times. In addition, Sun World has the right not to allow the Customer to visit other Parks without refunding the Ticket(s) purchased by the Customer and/or bearing any other responsibility; and/or b. Request the Customer to fully compensate for damages to the Park and related third parties (if any) and request competent authorities to handle the violations in accordance with Vietnamese law.
J. DISPUTE RESOLUTION
1. Responsibility for handling complaints and disputes: Depending on the issue arising, the party responsible for handling complaints and disputes with the Customer shall be determined as follows: a. Sun World is responsible for handling complaints and disputes with the Customer regarding issues related to accessing and using the Account, booking, purchasing and receiving Tickets on the Sun World Ticketing Channel and issues related to the validity and use value of Tickets directly provided by Sun World to the Customer. b. Other Distribution Channels are responsible for handling complaints and disputes with the Customer regarding issues related to the purchase and sale and validity and use value of Tickets directly provided by the Other Distribution Channels to the Customer. c. The Park Operator is responsible for handling issues related to the quality of services and products stated on the Ticket and issues arising when the Customer uses the Ticket at the Park. d. The Customer is responsible for directly resolving conflicts, disputes and claims for damages with other Customers (if any) arising before and during the visit and use of Tickets at the Park that are not caused by the fault of the Park Operator. The participation of the Park Operator (if any) shall only be as an intermediary for the purpose of coordinating and supporting resolution when deemed necessary or as requested by competent authorities. e. In cases where the Customer purchases and uses products and services at shops or stalls operated by partners or lessees of the Park Operator within the Park, the purchase and use of such products and services and/or the resolution of related issues shall be subject to the regulations of each respective shop or stall. If disputes arise, such partners or lessees shall be directly responsible for resolving them with the Customer. The Park Operator shall only participate as an intermediary to ensure harmonious interests between the parties.
2. If any dispute arises, the Parties shall negotiate in good faith on the basis of respect for each other's rights and interests. If within three (03) months from the date one Party receives written notice from the other Party requesting negotiation to resolve the dispute and such dispute cannot be resolved by the Parties, either Party shall have the right to bring the dispute to the competent court in Vietnam for resolution.
3. During the dispute resolution process, except for the Parties involved in resolving the dispute (courts, lawyers, etc.), the Customer undertakes not to provide information regarding the matter to any other third party. In case the Customer provides information about the matter to other third parties, leading to misunderstanding and affecting the image, reputation and brand of Sun World, the Park Operator and/or the Park, the Customer shall be responsible for compensation and other liabilities in accordance with Vietnamese law.
